Starting January 1, 2011, the following changes will affect Health Savings Accounts under the Health Care Reform, or the Patient Protection and Affordable Care Act:

  • HSA funds can no longer be used to buy over-the-counter drugs without a doctor's prescription.
  • Individuals who withdraw their HSA funds for non-medical purposes will see a tax penalty of 20% of the total withdrawal instead of 10%
