The terms “Credit Union”, “we”, “us” or “our” will refer to America First Credit Union.  The terms “you” and “your” will refer to the party providing consent to use this Service.

By using the Service, you agree to the following terms of use. If you do not agree to the following terms, you must not use the Service.

Acceptable Use. You will use the Services only for lawful purposes, in compliance with all applicable federal and state laws. You will not access, post or transmit any Prohibited Content on or through the Services. “Prohibited Content” means health data, content that violates the law, including content that infringes or misappropriates the rights of any third party and content that is used in violation of any license granted by the owner of such content, or any content or information impersonating another person or entity. You will not use the Service to communicate any message or material that is harassing, libelous, threatening, obscene, or indecent. You will not engage in any activity that could damage, disable, overburden, impair or otherwise interfere with or disrupt the Service. You will act and engage in a manner that is professional and courteous while on video with representatives from the credit union. You will not use language or gestures that are intended to harm, threaten, or demean. When using the system, you will be dressed in such a way that would be consistent with being present in a physical branch.

You will not, directly or indirectly, do, or allow anyone to do, any of the following: (a) reverse engineer, decompile, disassemble or otherwise attempt to discover the source code, object code or underlying structure, ideas, know-how or algorithms relevant to the Services or any related software, documentation or data related to the Services or upon which the Service are based; (b) modify, translate, or create derivative works based on the Services or any such software; (c) use the Service for timesharing or service bureau purposes or otherwise for the benefit of a third party, including affiliates; (d) access the Service for the purpose of building a competitive product or service or copying its features or user interface; (e) allow any third party not authorized by the Credit Union or its third parties to access or view the Services; or (f) obscure any proprietary notices or labels on any part of the Service.

No High-Risk Use. You will not use this service in high-risk or hazardous environments, and you further agree not to use the Service in an unsafe manner, including while driving, walking, or otherwise without your full attention where risk to you, your end users, or others may arise or result. You understand that all risks, injury and harm associated with doing so are your responsibility and NOT responsibility of the Credit Union or the Service.

Secure Surroundings. You understand that it is your responsibility to ensure your surroundings are secure while you engage in the Service. This includes but is not limited to securing your environment sufficiently from the possibility of any other individuals or devices from listening, broadcasting or otherwise intercepting, either purposefully or inadvertently, any information or other activity while the Service is in use.

Access Rights. If the Credit Union learns of any Prohibited Content on the Service, the Credit Union may remove such content from the Service or disable access to it. If your use of the Services violates any of these terms, the Credit Union may take responsive action, including issuance of warnings to you or the suspension or permanent termination of access to the Services, or any portion thereof, in its sole discretion.

System Requirements. Your use of the Service requires a compatible device and access to internet or a high-speed cellular network, which may result in additional costs to you. Your ability to access and use the Service may be affected by the performance of your device or connection speeds. High-speed Internet access is recommended. You are solely responsible for any fees that may apply to your access to or use of the Services, including fees for hardware, software, Internet access, or text messages. You agree that the foregoing are your responsibility.

Recording. You consent and agree to be recorded and for the Credit Union to use and retain the recording for training, verification, and validation purposes.

Data Use. The Credit Union uses a third party to provide the Services. You hereby grant to Credit Union a non-exclusive, worldwide, royalty-free right to share your usage data with the third party, which will collect and analyze information related to your use of the Services in aggregate or other de-identified form (User Data) to test, develop, improve and enhance the Services and for other development, diagnostic and corrective purposes in connection its products and services and the products and services of its affiliates. This data is protected by a written information security program designed to protect User Data and prevent a security breach, which includes administrative, technical, and physical safeguards designed to: (a) ensure the security and confidentiality of User Data; (b) protect against any anticipated threats or hazards to the security or integrity of User Data; and (c) protect against unauthorized access to or use of User Data. The information security program will be kept current based on changes in applicable legal and regulatory requirements related to privacy and data security, best practices and industry standards.

No Warranties. You agree that the Service is provided “as is” and we expressly disclaim all warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We make no guarantee, promise, warranty, or representation regarding the results that may be obtained from the use of the Service, that the Service will meet your requirements, or be uninterrupted, timely, secure, or error free. Any material or data downloaded or otherwise obtained through the use of the Service is at your own discretion and risk. You will be solely responsible for any damage to you resulting from the use of the Service.

Indemnification. To the extent not prohibited by applicable law, you agree to indemnify, defend, and hold Credit Union and its affiliates and each of our licensors and suppliers (“Indemnified Parties”) harmless, including any officers, directors, employees, shareholders, members, consultants, and agents of the Indemnified Parties, from any third party allegation, claim, proceeding, liability, damage, or cost (including reasonable attorneys’ fees) arising out of or related to (i) your use of the Service, (ii) your breach of this Agreement or violation of applicable Law, (iii) your infringement or violation of any proprietary rights or other right of any person or entity, (iv) a personal injury or property damage to a third party relating to your acts or omissions.

Limitation on Liability. Credit Union will not be liable for any special, incidental, indirect, consequential, exemplary, or punitive damages; termination, suspension, discontinuance, or disconnection of the Service; a failure of your internet services, downtime, or maintenance; or our failure to provide technical or other support services. These exclusion of damages and limitations on available damages apply to all claims, obligations, and liabilities arising out of or related to this agreement, and whether arising in tort (including negligence or strict liability), statute, contract, or any other legal theory, even if we have been advised of the possibility that such damages may be incurred by you and even if your remedies fail of their essential purpose.

Your use of video banking is subject to the terms of the Credit Union Membership and Account Agreement (including Electronic Funds Transfer Agreement and Disclosure; Funds Availability Policy) as supplemented by these terms and conditions and our Privacy Policy. These terms do not replace any other agreement we have with you including online banking.
